The author of an invention, utility model, industrial design, plant variety, topographies of integrated circuits is a natural person who has created them in the result of his or her creative work.

If the creation of an invention, utility model, industrial design, varieties of plants, topographies of integrated circuits involves several authors, all of them are called co-authors.
Personal non-property rights and related property rights belong to the author.

The right of authorship (the right to be recognized an author) is a personal non-property right and it is protected perpetual. The right of authorship is inalienable and cannot be transferred.

Persons who do not make any personal creative contribution to the invention, utility model, industrial design, varieties of plants, topographies of integrated circuits are not considered co-authors. Persons who render the author (co-authors) a technical, organizational or material assistance or help to register the right to use the topology can not be considered co-authors. Persons who only propose an idea and do not offer any creative efforts for its implementation can not be considered co-authors. Mere ideas are protected by neither copyright nor patent law.

Appropriation of authorship, forced co-authorship, illegal disclosure of an invention, utility model, industrial design or any other object of industrial property right without the author's consent before the official publication of the information thereof as well as infringement of the exclusive rights of patent holders entail liability in accordance with the law.

The author-the right holder is entitled to claim:

  • recognition of their rights;
  • restitution of the situation that existed before the infringement of rights;
  • suppression of actions infringing the right or creating the threat of its infringement;
  • compensation for damages;
  • indemnifications of moral harm;
  • any other measures related to protection of their rights provided for by legislative acts to be taken.
