Conditions for granting of legal protection

An industrial model under legal protection shall mean an art or art-design concept of a product which determines its appearance and is new and unique.

Novelty. An industrial model is considered to be new if it could not be identified from the data that has become opened to public in the world before the date of an industrial model priority.

On determining the novelty of an industrial model, all applications filed in the Republic of Belarus other persons, all unrecalled applications for the grant of a patent for an industrial model, as well as patented industrial models in the Republic of Belarus shall be included, on condition of their earlier priority.

Originality. An industrial model is considered to be original in case its visual characteristics are determined by creative work of an author (co-authors) of an industrial model.
