Procedure for registration
The legal protection of an appellation of origin in the Republic of Belarus is granted on the basis of its registration in the National Center of Intellectual Property. Upon the registration the said institution issues a certificate of the right to use an appellation of origin.
The application examination includes preliminary examination and patent examination.
The National Center of Intellectual Property carries out the preliminary examination after it has received a patent application for an appellation of origin.
The preliminary examination is carried out within three months from the date of filing of the application.
Preliminary examination checks the contents of the application, presence of all necessary documents, compliance with set requirements as well as the payment of a patent fee.
The examination is carried out after the application is accepted for a review. Afterwards, the patent authority takes one of the following decisions:
- decision on registration of an appellation of origin;
- decision on refusal of registration;
- decision on granting the rights to use an appellation of origin which has been already registered;
- decision on refusal to grant the aforementioned rights.
In accordance with Examination’s decision, the patent authority registers an appellation of origin in the State Register of appellations of origin of goods of the Republic of Belarus.
The Register includes the information related to the registration and grant of rights to use an appellation of origin, as well as all subsequent changes to such information. The contents of the information is determined by the patent authority.
The certificate of the right to use an appellation of origin is issued by the patent authority after the registration of the appellation of origin in the Register upon the payment of official fee.
The National Center of Intellectual Property publishes the information on the application no later than six months from the date of completion of the examination.
