Procedure for registration

The examination proceedings of an industrial model application shall be held within three months from the date of filing of the application with the national patent authority.

At the time of application examination, there are no checks for compliance of a claimed industrial model to the conditions of patentability. The examination checks whether all necessary documents have been submitted, whether they comply with the set requirements, and whether the claimed concept falls within the category of subjects protected as industrial models.

In case the results of the examination proceedings of an industrial model application certify that the industrial model application has been executed on the concept that does not belong to the subjects of protection as an industrial model, the patent authority makes a decision to refuse a patent.

In case the results of the examination proceedings of an industrial model application certify that the industrial model application has been executed on the concept that does belong to the subjects of protection as an industrial model as well as the documents of the application are correctly executed, the patent authority makes a decision to grant a patent. An applicant is  informed about this fact by written notification within five days from the date of such a decision.

An industrial model shall be registered in the State Register of Industrial models, based on the decision to grant a patent and on condition of the prescribed patent fee payment at an established rate.

The data on the patent for the industrial model is published in an official bulletin within three months upon the industrial model registration in the State Register of Utility Models.

The grant of the patent shall be performed by the patent authority within five days from the date of publication of the data on the patent for the industrial model.
